WA Operating Requirements

Learn about current requirements for Electronic Lodgment Network Operators (ELNOs).

Compliance in Western Australia 

Electronic Lodgment Network Operators must comply with the WA Operating Requirements. 

Section 22 of the Electronic Conveyancing Act 2014 (ECA) authorises the Registrar of Titles (the Registrar) to determine, in writing, the Operating Requirements for: 

  1. the operation of an ELNO; and 
  2. the provision and operation, by an ELNO, of an Electronic Lodgment Network (ELN). 

Under section 24 of the ECA, the Registrar must consider the desirability of keeping the Operating Requirements consistent with any model provisions. ARNECC published Model Operating Requirements Version 7.2 (MORv7.2) in May 2026.

WA Operating Requirements Version 7.2 (WAORv7.2) has been prepared having regard to MORv7.2.

WAORv7.2 comes into effect in Western Australia on 29 June 2026. The current version of the WA Operating Requirements, Version 7.1, remains effective until 29 June 2026.

Waivers

Under section 27(1) of the ECA, a waiver from the obligation to comply with a provision of the Operating Requirements may be granted if it is reasonable in all the circumstances.
