Freedom of information

Documents that may not be available as part of our normal course of business may be requested via a freedom of information (FOI) request.

Freedom of information

The Freedom of Information Act 1992 (WA) gives you a legal right, subject to some limitations, of access to documents held by most state and local government agencies.  In our case, it facilitates public access to documents held by Landgate and to enable individuals to ensure that personal information in documents is complete, up to date and not misleading.

Documents considered may include written material, plans and drawings, photographs, tape recordings, films, videotapes or information stored in digitised format.

The Freedom of Information Act does not apply to documents held by Landgate that are available for purchase by the public.

In compliance with this Act, we publish an information statement on an annual basis. Our information statement includes:

  • our structure, functions and values
  • our legislation
  • our decision making functions and participation of the community
  • documents held by the agency
  • FOI procedures and access arrangements and fees.

Requests for access to documents should be made, in the first instance, to Customer Service officers. Often material may be made available without the need to formalise a request under the Freedom of Information Act.

How to make a FOI application

Access applications must:

  • be in writing
  • give enough information so that the documents requested can be identified
  • give an Australian address to which notices can be sent
  • be lodged at the agency with any application fee payable.

FOI applications, payments, correspondence and general enquiries should be directed to:
